LONG, Justice.
This suit was instituted by John Sayles and other property owners in the Highlands Addition to the City of Abilene against James E. Morton and wife to enjoin defendants from erecting a gasoline filling station on certain lots in said addition. Plaintiffs alleged that said Highlands Addition is now, and for several years, has been restricted to residential purposes and uses; that defendants, in violation of said restriction, were preparing to erect in said addition, a gasoline filling station.
