KALODNER, Circuit Judge.

This is an appeal by the plaintiff from the Order of the District Court for the Eastern District of Pennsylvania dismissing with prejudice plaintiff’s personal injury action against defendants arising out of an automobile accident in Bowling Green, Virginia, in 1956. Plaintiff is a citizen and resident of New York; defendants are citizens and residents of Pennsylvania. Plaintiff’s automobile was first hit by another operated by Luther L.
