MEMORANDUM OPINION
HOYT, District Judge.
Pending before the Court again, are the cross-motions for summary judgment of the plaintiffs, Thyssen Steel Company and Associated Metals & Minerals Corporation (instrument # 38), and the defendant, Dodeka-ton Corporation (“Dodekaton”) (instrument #39). This case is on remand from the Fifth Circuit Court of Appeals, where that court reasoned that Thyssen has the burden of proving that Dodekaton, in fact, granted Eurolines permission to sign bills of lading on behalf of Dodekaton.
