MEMORANDUM AND ORDER
WILLIAM A. HILL, Bankruptcy Judge.
This ease presents the issue of whether a spouse’s interest in an award of marital property can be preserved under the theory of constructive trust.
The Plaintiff, Nancy Butts (NANCY), and Defendant/Debtor, Richard Loren Butts (RICHARD), were divorced by decree entered in state court on July 11,1983. Richard filed a petition under Chapter 7 of the Bankruptcy Code on March 30, 1984.
