Appeal by the plaintiff, Frank Grant, from an order of the Supreme Court, made at the Oswego Trial Term and entered in the office of the clerk of the county of Oswego on the 18th day of November, 1904, putting the case over the term at which the trial was begun, and requiring the plaintiff to pay the defendant term fees, trial fee and taxable disbursements for the term, amounting to rixtv-nine dollars and seventy cents, within ten days.

Williams, J.:

The order appealed from should be reversed, with costs. _ The action was to recover damages for personal injuries alleged to have been the result of defendant’s negligence. The case came on at the Trial Term of the court; the trial was moved and the impaneling of the jury was commenced. .Plaintiff’s counsel asked the following question: “ Q.
