Appeal from a judgment of the County Court of Clinton County (Ryan, J.), rendered February 23, 2006, upon a verdict convicting defendant of the crime of promoting prison contraband in the first degree.
*658In May 2005, defendant, an inmate at Clinton Correctional Facility in Clinton County, was charged in an indictment with two counts of promoting prison contraband in the first degree and one count of criminal possession of marihuana in the fifth degree.
