This is an action brought by the pro se petitioner, Simon B. Then (the “Petitioner” or “Then”), a detainee at the Detention Center of the Immigration and Naturalization Service (the “INS”), Jersey City, New Jersey, against the respondent, the INS. Presently pending is the petition (the “Petition”) of Then for a writ of habeas corpus, pursuant to 28 U.S.C. § 2241 (“Section 2241”), seeking, inter alia, a preliminary injunction (the “Preliminary Injunction Application”) enjoining the deportation of the Petitioner from the United States and relief from a final order…
