Tyler, J.), entered on or about October 21, 1987, which denied plaintiffs’ motion for partial summary judgment on the first and second causes of action and granted defendant’s cross motion for summary judgment dismissing the complaint, is unanimously modified on the law to the extent of granting plaintiffs’ motion for partial summary judgment on the second cause of action and denying defendant’s cross motion to dismiss the second cause of action and otherwise affirmed, with costs and disbursements to plaintiff.
