Appellants, Gregory Jordan, et al., appeal from a decision of the district court refusing relief, under Fed.R.Civ.P. 60(b), 1 from an earlier dismissal of their suit against the United States for damages resulting from alleged misconduct by United States Marshals during an eviction. The district court dismissed the suit for failure properly to serve the United States pursuant to Fed.R.Civ.P. 4(d)(4). 2 Because so far as we can tell on the record before us, the failure to serve the United States was not fault attributable to appellants, we remand the case to the district…
