REINHARDT, Circuit Judge:

Plaintiff Stephen Borzeka appeals the district court’s order granting the Secretary of Health and Human Services’ motion to set aside a default judgment against her and to dismiss plaintiff’s complaint for failure to coniply with the technical requirements of service under Rules 4(d)(4) and (5) of the Federal Rules of Civil Procedure. We affirm the district court’s order insofar as it sets aside the default judgment against the Secretary, but reverse insofar as it dismisses plaintiff’s complaint for lack of proper service.
