This matter is currently before this Court on the motion for summary judgment filed by the Resolution Trust Corporation (RTC), as Conservator for Capital-Union Federal Savings Association (New Capital-Union), concerning two secured promissory notes executed by Keith R. and Maureen Cooper Dubois. Also pending before this Court is a motion by the RTC, as Receiver for Capital-Union Savings, F.A. (Old Capital-Union), to dismiss the defendants’ counter-claims. 1 The RTC is seeking…
