POLOZOLA, District Judge.

The Federal Deposit Insurance Corporation (“FDIC”) as receiver for Sun Belt Federal Bank, F.S.B. (“Sun Belt”) has moved for partial summary judgment as to the affirmative defenses of contributory negligence, failure to mitigate damages and es-toppel. 1 In response to plaintiff’s complaint, the defendants asserted the affirmative defenses set forth above.
