Appeal from a judgment of the Supreme Court, entered March 7, 1969 in Albany County, upon a verdict rendered at a Trial Term in favor of plaintiffs. Carl Bacon, an employee of defendant, the operator of an apple orchard, lived with his wife in a house on employer’s property. A plank walk*709way, consisting of two one inch by six inch planks laid “ kind of ” level side by side and end to end, extended about 30 feet to a privy. On May 5, 1965 between 7:00 and 7:30 in the morning, the wife, proceeding on the walkway toward the outhouse with a night chamber, slipped and fell, sustaining an ankle…
