Plaintiff Mark Goldsmith, M.D., filed a complaint on January 23, 1991 seeking declaratory and injunctive relief against defendant Harding Hospital. Plaintiff asserted in his complaint that he was denied due process of law by reason of defendant’s suspension of his participation in a psychiatric residency program. Plaintiff alleged that defendant’s conduct violated provisions of the Health Care Quality Improvement Act of 1986, (“HCQIA”) 42 U.S.C. § 11111, et seq.
