This action was instituted in the probate court of Cowley county by Dupuy G. Warrick against the estate of W. M. McKnab, deceased, for an accounting of the profits of an oil lease block alleged to be due under the terms of a written contract. A demurrer was sustained to claimant’s evidence in the probate court and he appealed to the district court. On trial in that tribunal a similar demurrer was overruled.
