ROGERS, Chief Judge:
This is an appeal from the grant of summary judgment to appellee Griffiths-Gar-cia Corporation on appellant Johannes C. Cooke’s complaint alleging tortious interference with contractual relations and requesting the imposition of a constructive trust. 1 Appellant primarily contends that summary judgment was inappropriate because there are disputed issues of material fact. We agree, and reverse.
