Based upon a motion argued on June 24, 1999, this court previously granted summary judgment in favor of the Sear-Brown Group, formerly known as Sear-Brown Associates, P. C. *365(Sear-Brown), in regard to plaintiffs’ claims, as set forth in the complaint. The plaintiff, Reginald Rogan, sustained an injury on July 18, 1994, while working on an underground irrigation system located at Hobart &' William Smith Colleges.
