— Appeal from an order of the Supreme Court at Special Term (Ford, J.), entered September 17, 1981 in Montgomery County, which granted defendant’s motion to dismiss the complaint. Plaintiff’s notice of claim against defendant school district, alleging that 12-year-old plaintiff Roy De Ronda was injured at school on October 16, 1978, was timely filed on January 11, 1979. Defendant' responded with a notice for examination of plaintiff, pursuant to section 50-h of the General Municipal Law, to be held on February 27, 1979.
