HUNT, Circuit Judge.
Suit for infringement of letters patent No. 1,052,270, issued to the plaintiff on an application filed June 29, 1906, which was the continuation of, and the substitute for, an application filed May 21, 1906. The wheel made by defendant is alleged to contain and embody plaintiff’s invention as in claims 8, 11, 12, and 13. The defendant denies (a) infringement; (b) that plaintiff was the original and first inventor of the alleged improvement in wheels contained in said patent; and (c) that it was not known and used by others before its alleged invention by plaintiff.
