Furniture Brands International, Inc. (“plaintiff’) has brought suit against Customs and Border Protection (“Customs”), the International Trade Commission (“ITC”), and, in their official capacities, Customs Commissioner Bersin and ITC Chairperson Okun (collectively “defendants”), to recover funds it believes it is owed under the Continued Dumping and Subsidy Offset Act of 2000 (“CDSOA”), 19 U.S.C. § 1675c, repealed by Pub.L.
