Defendant appeals from a judgment in the district court.
Plaintiff brought suit to recover damages for personal injuries suffered by her in an automobile accident. The defendant was the owner and driver of the car, and plaintiff was a passenger therein. The case was first tried before Judge Magney and a jury. A verdict for plaintiff for $100 was returned. Plaintiff made two motions, one for a new trial generally, and one for a new trial of the amount of damages only.
