MARGOLIS, Judge.

This case is before this Court on defendant’s motion to dismiss, or in the alternative, for summary judgment, plaintiff’s opposition, and supplemental briefs, submitted with oral argument. Plaintiff William S. McPherson, a former special delivery messenger with the United States Postal Service (USPS) was found in possession of stolen mail matter and was subsequently removed for conduct unbecoming a postal employee.
