The defendant in error is a water improvement district organized under chapter 2, title 73, Vernon’s Texas Civil Statutes Supp. 1918, and as such sued the defendants, owners of property within the district, for the enforcement of a tax lien by virtue of a levy made by it for the payment of certain expenses of organization and maintenance of the district. The. district was organized in March, 1922; the levy under which the attempted foreclosure is sought was made in July, 1922.
