Plaintiffs filed this action on March 21, 2012, alleging that Nitro-Lift failed to pay overtime wages in violation of the Fair Labor Standards Act (“FLSA”), 29 U.S.C. § 206 et seq. and Oklahoma’s Protection of Labor Act (“OPLA”), 40 OKLA. STAT. § 165.1 et seq. On June 21, 2012, the court denied Defendant’s motion to dismiss and compel arbitration, holding that the arbitration clause within the confidentiality and non-compete agreement only applies to matters within the scope of that agreement.
