On February 3, 2002, plaintiffs were arrested following their participation in an animal rights march during the World Economic Forum (“WEF”) in New York City. They brought this action against the City of New York and various employees of the New York City Police Department (“NYPD”) (collectively, the “City”) asserting claims under 42 U.S.C. § 1983, including a claim that the police deliberately held them in custody for an unnecessarily long period of time in order to delay their arraignment in Criminal Court.
