OPINION

BECHTLE, District Judge.

This matter is before the Court on plaintiff’s motion for. summary judgment in the amount of at least Fifty-Six Thousand Five Hundred Dollars ($56,500.00), on a claim under a comprehensive liability insurance policy, and defendant’s cross motion for summary judgment mainly on the ground that the claim is of the type that falls within two of the exclusionary provisions of the policy.
