The defendant, Louis McNack, was jointly charged with John Henry Green and Leon Pride in the district court of Muskogee county with the crime of burglary in the second degree. The defendant took a severance, was tried and convicted, and was sentenced to serve a term of three years in the penitentiary, and has appealed to this court.'
