MEMORANDUM OPINION

On September 21, 1992, this matter came before the Court as a hearing on the motion of defendant Robert A. Trevisani (“Trevisani”) for summary judgment and on cross-motion of Plaintiff/Intervenor, Department of Energy (“DOE”) for partial summary judgment. The last post-hearing memoranda was filed, and the matter was taken under advisement on October 9,1992.
