This is a case of first impression. Mon-zell Butler, the defendant below, was charged, tried by a jury, convicted in the district court of Atoka county, and sentenced to a year and a half in the State Penitentiary for the crime of fraudulent branding of cattle in violation of the provisions of Title 4 O. S. A. § 268, the material part of which reads as follows, to wit:
