This proceeding was instituted by the appellee, the city of Alexandria, before the board of commissioners of Madison county, for the purpose of annexing a tract of unplatted land contiguous to said city, constituting a part of the real estate and right of way of the appellant. The appellee, by its common council, filed a petition before the board of commissioners setting forth the reasons for annexation, and notice of said petition was given by publication in the planner prescribed by the statute.
