Affirming.

The legislative department of the city of Louisville in April 1938 enacted “An ordinance pertaining to the regulation of sanitary conditions, public health, public safety, public welfare, public morals, business hours and conduct of barber shops.” The enacting portion of the ordinance was preceded with eleven “whereases” employed, no doubt, to stabilize the confidence of the enacting board or boards in its authority to prescribe as is done in Section III of the ordinance, which says: “That it shall be unlawful for any person, firm, association or…
