The property involved in this controversy is a coal mine and its appurtenances, situated at Sandoval, in Marion county, Illinois. In St. Louis and Sandoval Coal and Mining Co. v. Sandoval Coal and Mining Co. 111 Ill. 32, we decided that the legal title to the property was in the St. Louis and Sandoval Coal and Mining Co., (called the old company,) and that the sale by the receiver in this cause to Isaac Main was void, and, by consequence, that the Sandoval Coal and Mining Co., (called the new company,) which held under a conveyance from Main, had no legal title to the property.
