MEMORANDUM OPINION
KATZ, Senior District Judge.
This matter is before the Court on Defendant’s motion to dismiss, Plaintiffs response and Defendant’s reply thereto. For the reasons stated below, Defendant’s motion will be denied.
Background
This action is related to a pending viatical insurance case which has spawned its own universe of civil litigation and resulted in multiple criminal convictions for the principals therein.
