Tort for causing the death of Athanasios Papandrianos, the plaintiff’s intestate. Writ dated December 12, 1918. In the Superior Court, the action was tried before Fessenden, J. This action is brought to recover the penalty prescribed by St. 1906, c. 463, Part I, § 63, as amended by •St. 1907, c. 392 and St. 1912, c. 354 (now G. L. c. 229, § 3) for the death of the plaintiff’s intestate, who was a section hand in the employ of the defendant.
The accident occurred about a quarter past five o’clock in the afternoon of December 14, 1917, in that part of Boston known .as Allston.
