Antone Lapara, the defendant herein, was charged with the crime of murder. He was convicted of murder in the first degree. This appeal is from a judgment of the superior court of the city and county of San Francisco imposing a death sentence as the penalty for the crime.

The principal points presented in support of the appeal involve the correctness and consequences of a ruling of the trial court concerning the admissibility of certain evidence and the refusal of the trial court to permit counsel for the defendant to argue the ease to the jury upon the theory that it was one of circumstantial…
