MEMORANDUM OPINION AND ORDER
DE MENT, District Judge.
Before the court are two Motions For Summary Judgment filed by Plaintiff and Defendant (“Pl.’s Mot.” and “Def.’s Mot.,” respectively), on May 24, 2000. 1 After careful consideration of the arguments of counsel, the relevant law, and the record as a whole, the court finds that Plaintiffs Motion For Summary Judgment is due to be denied and Defendant’s Motion For Summary Judgment is due to be granted.
