This action was brought to recover damages for the alleged wrongful death of James Willoughby. There was a judgment for $3,000 damages in the criminal and law court of Campbell county, from which an appeal *259was prayed to the court of civil appeals. That court held that the trial court should have sustained the plaintiff in error’s motion for peremptory instructions, and accordingly dismissed the suit. The case was then brought here by the writ of certiorari.
