This matter is before the court on defendants' motion to dismiss. (Doc. No. 51.) On December 19, 2017, a hearing on the motion was held. Attorneys Teresa Allen, Michael Haddad, and Sanjay Schmidt appeared telephonically on behalf of plaintiff Jeremy Lapachet. Attorneys Jemma Saunders, Jesse M.
