Charles Simon (“Simon” or “plaintiff’) brings this action against KeySpan Corporation (“KeySpan”) and Morgan Stanley Capital Group Inc. (“Morgan Stanley”) (collectively, the “defendants”) pursuant to Section 4 of the Clayton Antitrust Act (the “Clayton Act”) on his own behalf and on behalf of other similarly situated consumers. 1 Simon is a retail consumer of electricity in New York City.
