The defendant is charged with criminal possession of a controlled substance in the fourth degree and the fifth degree and criminally using drug paraphernalia in the second degree. Another IAS Judge granted a pretrial Mapp and Huntley/ Miranda hearing to determine whether property seized from the defendant and from a room that was searched as well as a statement made by the defendant should be suppressed.
