Defendants’ Fed.R.Civ.P. 12(b)(6) motions to dismiss require that the court decide whether plaintiffs have stated claims under the Electronic Communications Privacy AcL-Stored Communications (“ECPA”), 18 U.S.C. § 2701 et seq., and whether plaintiffs’ state-law claims are preempted by the Airline Deregulation Act of 1978 (“ADA”), and, if not, whether plaintiffs have stated state-law claims on which relief can be granted.
