This was a suit brought in the Superior Court of Marion County by appellee as the administrator of the estate of Cassius C. Van Laningham, on account of the death of his decedent, which it is averred in the complaint was caused by the negligence of appellant in running one of its passenger-trains upon decedent at a highway crossing-in Marion comity. The venue was subsequently changed to Johnson county, where the cause ivas tried. The amended complaint on which issues were joined was in two paragraphs.
