This case is one of a number of cases before the Court of Federal Claims involving contracts1 between nuclear utilities and the United States Department of Energy (“DOE”) for the disposal of spent nuclear fuel (“SNF”) and/or high-level radioactive waste (“HLW”)- Plaintiff, Energy Northwest, is comprised of 22 public utility districts or municipal utilities spread across the state of Washington.
