HAMILTON, Judge.

Movant, Arthur Moton, appeals from the denial of his Rule 29.15 motion without an evidentiary hearing. We affirm.

On December 18, 1984, Patrolman Luther Hanna swore in a complaint filed in associate circuit court that Movant committed the class D felony of unlawful use of a weapon and the class C felony of receiving stolen property. On January 7,1985, counsel entered his appearance on behalf of Movant, and the Court set a preliminary hearing for February 11, 1985.
