Mrs. Blankenship sued the Baptist Memorial Hospital and Dr. J. E. Whiteleather for damages for personal injuries resulting from third degree X-ray burns alleged to have been negligently inflicted upon her by the defendants in the treatment ~of cancer of the cervix.
At the close of all the proof motions were made by both defendants for peremptory instructions in their favor. The court sustained the motion of the hospital and overruled that of Dr. Whiteleather; whereupon the plaintiff took a voluntary non-suit as to Dr. Whiteleather, and filed its motion for a new trial as to the Hospital, and…
