TOULMIN, District Judge.
This is a bill to enjoin the further prosecution of two actions of ejectment, pending on the law side of this court, which the city of Mobile has instituted against the complainant, each for the recovery of a separate and distinct tract of land; the two tracts being held by the complainant under different titles. The case comes before the court on a motion to dismiss the bill for the want of equity, and on demurrers to the bill.
