This is an appeal from a judgment in habeas corpus discharging the appellee, Walter Cleveland, from the state penitentiary; said discharge being based upon a pardon issued by the Lieutenant Governor of the state. The case comes here on an agreed statement of facts, which is as follows:

“That the relator on the 11th day of November, 1922, was a convict in the Mississippi state penitentiary, and that he had properly had published and filed in the office of the Governor of the state a petition praying that he be granted a pardon for the offense of which he had been convicted, and that on the 11th…
