This suit involves the title to the office of member of the board of police and fire commissioners' of the city of Lexington, appellant and appellee each claiming to be the rightful incumbent. Lexington is a city of the second class. The statute providing a system of government for these cities creates a board called the “Board of Police and Fire Commissioners,” which is composed of the mayor of the ■city, ex officio, the' chairman of the board, and four other members appointed by the mayor.
