BUSSEY, Judge.
This is an original proceeding in habeas corpus wherein the petitioner, Gurney Will Luckens seeks his release from confinement.
The record shows that on the 13th day of March, 1961, the petitioner was sentenced by the District Court of Oklahoma County, Oklahoma, on his plea of guilty to a charge of Burglary in the Second Degree, District Court Case No. 26929, to a term of four years in the State Penitentiary at McAles-ter, Oklahoma, which judgment and sentence was suspended under the terms and conditions of title 22 Okl.St.Ann. § 992.
