I. INTRODUCTION

Vincent Treanor, a former employee of the Long Island Rail Road (“LIRR”), brings this action against the Metropolitan Transportation Authority (“MTA”) and the LIRR alleging employment discrimination on the basis of disability in violation of the New York State Human Rights Law 1 and the New York City Human Rights Law. 2 He also claims that defendants violated the notice requirements of the Consolidated Omnibus Budget Reconciliation Act (“COBRA”). 3 The LIRR now moves to dismiss pursuant to Rule 12(b)(6) of the Federal Rules of Civil…
